Hours after a Federal High Court sitting in Lagos ordered the Department of State Security (DSS) to release the Managing Director of Capital Oil and Gas Limited, Mr Ifeanyi Ubah, an FCT High Court sitting in Abuja granted an exparte motion filed by the DSSto extend the detention of Ubah for a further period of 14 days.
Justice Yusuf Halilu ruled that it is only fair in the interest of justice that the DSS be given more time to conclude its investigation.
The judge had also dismissed Ubah’s application asking the court to vacate its earlier order granted on May the 10th that allowed DSS to detain Ubah for 14 days.
The initial exparte order elapsed on May the 24th, and counsel to DSS, informed the court of a new motion brought pursuant to Section 296(2) of the Administration of Criminal Justice Act, asking for an order of the court to extend the detention of Ubah for a further period of 14 days.
He said this is because the DSS couldn’t conclude investigation within the earlier 14 days because the investigation took on a wider dimension.
