Ex-NSA Dasuki asks court to stop trial again

TVC E, NEWS – Former National Security Adviser, Col. Sambo Dasuki has again asked a federal high court in Abuja to stop his trial and set aside the charges brought against him by the Federal Government of unlawful possession of fire arms.

Dasuki  told the court that the federal government no longer has moral or legal rights to continue his trial having disobeyed the order of bail granted him since November last year.

Among other requests, Dasuki asked Justice Adeniyi Ademola not to indulge the Federal government any longer until it purges itself of contempt.

While arguing the motion, Daudu claimed that since November 3rd 2015 when his client was re-arrested by operatives of the Department Of State Service (DSS), after meeting bail conditions, he has  been held in custody without trial without reasons for his incarceration made known to him.

The counsel insisted that the bail order that admitted Dasuki remains valid having not been set aside by the court and as such must be obeyed in the interest of justice.

He claimed that his client cannot be lawfully prosecuted because his right to prepare adequately for his defence as enshrined in the bail, has been violated having been kept away from his lawyers.

He therefore urged the court to prohibit the trial of Dasuki until the government has done the needful.

Opposing to the application, counsel to the FG, Dipo Okpeseyi (SAN) urged the court to disregard the application, because its purpose was to frustrate the trial.

Okpeseyi pointed out that the bail granted the defendant did not prohibit his re-arrest in connection with any other matter.

The counsel denied the allegation that the government stopped Dasuki from going abroad for medical check-up as ordered by the court, adding that the passport of the defendant was not in the custody of the FG.

After listening to arguments from both parties, Justice Ademola fixed ruling on the application for 4th of April.
