American actress, Amber Heard has taken to the Virginia courts to file a new appeal, months after she lost to ex-husband Johnny Depp in the highly publicized defamation case.
Amber Heard Demands New Trial Against Johnny Depp
According to reports, The Aquaman star is asking for a reversal of the decision or a new trial in the defamation case, which she lost earlier this year, claiming that the six-week-long trial was held in the wrong state.
In a 68-page appeal, Heard’s attorneys have objected to the jury’s decision to exclude certain pieces of evidence, including contemporaneous notes from therapists that they say document allegations of abuse, which according to her resulted in an unfair trial.
The actor’s legal team has asked the court to reverse the verdict of the jury which mainly sided with Depp and awarded him over ten million dollars in damages.
Amber Heard’s lawyers stated, “The trial court improperly prevented the jury from considering several separate instances in which Heard reported Depp’s abuse to a medical professional.
“If not reversed, the trial court’s exclusion of contemporaneous reports of domestic abuse to medical professionals will make it more difficult for other abuse victims to prove allegations of abuse, and likely deter them from coming forward.
“That holding, if allowed to stand, undoubtedly will have a chilling effect on other women who wish to speak about abuse involving powerful men.”
Her legal team which comprises a different set of lawyers than those who represented her during the trial, also argued that the trial, which took place in Fairfax, Virginia, should have taken place in California, where the once-married couple lived together.
Just so you know, if this becomes successful, it will be Amber Heard and Johnny Depp’s third time in court, first, a UK court ruled in favour of Heard, and then a US court ruled in favour of Depp.
