The Supreme Court will on May the 4th, hear an objection filed against the hearing of an appeal brought before the court by the Ahmed Makarfi-led committee of the Peoples Democratic Party.
The motion challenging the competence of Makarfi’s appeal was filed by the Party’s Counsel, Lateef Fagbemi and another motion filed by Sheriff’s Counsel, Akin Olujimi for the same purpose.
The PDP and Sheriff’s faction, in two motions, are asking the apex court to strike out Makarfi’s appeal, on the ground that they have no authority to file it on behalf of the PDP.
The two applicants are contending that by virtue of the court of appeal judgment, delivered on February 27th 2017 in Port Harcourt,
The issue of authentic leadership for the people’s Democratic Party has been settled .
They are also contending that since the Makarfi-lead leadership had lost at the appellate court , it has no legal standing to file any appeal on behalf of the people’s Democratic Party as an appellant in the suit.
They also insisted that the appeal filed by Makarfi had become incompetent since it was filed without the authorization by PDP or its leadership.
The five man panel, led by Justice Tanko Mohammed, subsequently fixed may 4th, for hearing of the two motions.
